Abstract |
Background. According to p. 1 art. 1 of fundamental principles of the Russian legislation on the notary, notaries public in the Russian Federation are to provide protection of rights and legal interests of citizens and legal entities in accordance with the Constitution of the Russian Federation, constitutions (charters) of subjects of the Russian Federation, Fundamentals of legislation. The said protection is performed by notaries through improvement of notarial actions, stipulated by legislative acts, on behalf of the Russian Federation.
Materials and methods. The author analyzed the Constitution of the Russian Federation (adopted by a natiowide vote on 12.12.1993) (subject to amendments by RF laws on amendments to the RF Constitution from 30.12.2008 № 6-FKZ, from 30.12.2008 № 7-FKZ, from 05.02.2014 № 2-FKZ, from 21.07.2014 № 11-FKZ); Fundamental principles of the Russian legislation on the notary (adopted by the Supreme Court of RF on 11.02.1993 № 4462-1) (revised on 13.07.2015); the Federal law from 29.12.2014 № 457-FZ “On amendments to certain legislative acts of the Russian Federation”; The Decree of the Ministry of Justice of RF from 15.03.2000 № 91“On adoption of Methodological recommendation on improvement of certain types of notarial actions of notiries of the Russian Federation”; the Code of civil procedures of the Russian Federation from 14.11.2002 № 138-FZ (revised on 06.04.2015) (revised and amended, effective from 15.09.2015); the Code of arbitration procedure of the Russian Federation from 24.07.2002 № 95-FZ (revised on 29.06.2015) (revised and amended, effective from 01.10.2015); the Federal law from 22.02.2014 № 20-FZ (revised on 05.10.2015) “On election of deputies of the State Duma of the Federal Assembly of the Russian Federation”; the Federal law from 12.06.2002 № 67-FZ (revised on 05.10.2015) “On basic guarantees of electoral rights and the right to participate in referendum for citizens of the Russian Federation”; the Federal law from 10.01.2003 № 19-FZ (revised on 24.11.2014) «On presidential elections in the Russian Federation”.
Results. Analysis of the active legislation allows to amend the existing classification of notarial actions in the sphere of protection of constitutional rights of citizens with two more paragraphs – “notarial actions in the sphere of protection of the constitutional right to address to state organs and local self-government organs”, “notarial actions, aimed at protection of constitutional rights in the field of elections”.
Conclusions. As we can see, the importance of the notarial institution regarding protection of constitutional rights and freedoms of citizens in the modern society can scarcely be overestimated. Being an indispensable part of the Russian law system, notaries efficiently perform their functions in protection of various constitutional rights of citizens.
